我国当前的环境法治以行政区划为基础,以点源污染防治为重点,人为分割环境,违背区域环境的整体性,导致跨行政区边界区域环境问题丛生。目前的研究主要集中在该现象的法治原因分析、立法和体制完善、区域环境执法联动机制设计等方面,对区域环境纠纷解决机制探讨相对薄弱。当前的环境法研究亟需突显环境法治的区域性理念;强化区域环境法治的程序性,彰显司法的终局裁判价值;尊重区域居民环境权益,充分保障和发挥其主体能动性;总结、引导和规范当前的跨行政区环境合作实践,将其纳入法治渠道。
The current law of the environment in our country is based on administrative divisions and focuses on the prevention and control of point source pollution. Artificially dividing the environment and violating the integrity of the regional environment lead to environmental problems in the border regions across the administrative regions. The current researches focus on the analysis of the rule of law of the phenomenon, the improvement of the legislation and system, the design of the linkage mechanism of regional environmental law enforcement, and the relative weakness of the regional environmental dispute resolution mechanism. The current research on environmental law urgently needs to highlight the regional idea of environmental law and order; strengthen the procedural of the rule of law in the regional environment and highlight the value of judicial adjudication; respect the environmental rights and interests of residents in the region, fully guarantee and give play to their initiative; and summarize, guide and regulate current Trans-administrative region environmental cooperation practice, will be included in the channel of rule of law.
