量刑话语权是被告人应当享有的基本权利。它不仅是一项诉讼权利,更是一项实体权利。被告人享有量刑话语权存在坚实的理论依据,即被告人享有自行辩护权、大众话语权的法学研究范式、刑法的契约化、经验主义的惩罚分配原则。其实,被告人量刑话语权应上升为一种主流意识形态。被告人量刑话语权的有效实现,依赖于法官——被告人互动式量刑参与制度的构建。
The right to weigh the discourse is the basic right that the defendant should enjoy. It is not only a litigation right, but also an entity right. There is a solid theoretical basis for the defendant to enjoy the right of sentencing the discourse, that is, the legal research paradigm of defendants enjoying their own right of defense and public discourse, the contractualization of criminal law and the principle of punishment and empiricism. In fact, the defendant’s right to weigh the discourse should rise to a mainstream ideology. The effective realization of defendant’s right of sentencing depends on the construction of an interactive system of participation of sentencing by judges and defendants.
