不利可得事实原则(简称"AFA规则")是美国商务部在反补贴反倾销案件常使用的一种调查方法,是美国进行贸易救济和贸易保护的一种有效方式。近十年来,随着美国对华双反案件的增多,如何应对美国对华适用的AFA规则,也就成为保护我国出口商利益和国家利益的有效手段。本文通过对2006年至今商务部对华反补贴案例的探讨,分析美国对华反补贴案件裁定中AFA规则的运用,指出美国裁定的不合理性,进而提出我国企业的应对策略。
