社会矛盾的实质是法权关系的失衡,权力失衡产生权力主导型矛盾,权利失衡产生权利主导型矛盾,权力主导型矛盾继续往下细分可分为权力－权力类社会矛盾和权力－权利类社会矛盾,权利主导型矛盾继续往下细分可分为权利－权力类社会矛盾、权利－权利类社会矛盾.社会矛盾法律化解模式的实质是法权,即通过权利与权力的重新分配,调动不和谐的利益因子,实现矛盾冲突的衰败和社会矛盾的消解.其中内含的法权逻辑即以权力限制和权利保障为出发点,矫正较强的权力和较弱的权利,使权利与权力对抗,权力与权力抗衡,最终实现权利与权力之间及权利与权力所隐含的权利与义务之间、权力与责任之间的均衡.
