民法规则和民法原则作为两个不同的概念,在法律实践当中却体现出了特定的相关性,对于具体案件的审判,综合参照民法规则和民法原则有利于进一步保证法律实践审判的合理性,对于我国法治化进程的进一步深入有着至关重要的促进作用。文章以此为出发点,谈民法原则与民法规则的异同,并分析两者之间的关系,以期为相关领域深入研究提供一些理论参考。
Civil law rules and civil law principles are two different concepts, which reflect specific relevance in legal practice. The trial of specific cases and the comprehensive reference to civil law rules and civil law principles are conducive to further ensure the rationality of trial of legal practice. The further deepening of the process of rule by law in our country plays an important role in promoting. Taking this as a starting point, the article talks about the similarities and differences between the civil law principles and the civil law rules, and analyzes the relationship between the two, with a view to providing some theoretical references for further research in relevant fields.
