海事赔偿责任限制是在一定程度和范围内对海上责任人的赔偿责任进行的限制,对其合法权益进行保护,从而促进航运业的发展。但是,为了避免责任人权利的滥用,规范责任人必要的海上行为,又不得不对这种赔偿责任限制权利进行反限制,这就是海事赔偿责任限制权利的丧失。本文结合我国《海商法》的相关规定,对责任限制权利丧失的一系列相关问题进行深入的探讨。
Limitation of liability for maritime claims is to a certain extent and limit the liability of the sea-based persons to carry out the restrictions on their legitimate rights and interests to protect and thus promote the development of the shipping industry. However, in order to avoid the misuse of the rights of the responsible persons and to regulate the essential maritime acts of the responsible persons, it is necessary to counterbind the restriction of the rights of limitation of liability, which is the loss of the right to limit the liability of maritime claims. Based on the relevant provisions of “Maritime Law” of our country, this article discusses in depth a series of related issues of the loss of the right to limit liability.
