本文对《纽约公约》关于裁决的承认与执行条款在澳大利亚与新西兰的实施现状及其解释作了分析。虽然目前在新西兰相关判决尚未出现,但澳大利亚法院却审视了一系列重要问题,包括临时裁决和中间裁决的效力、执行程序所应适用的时效、法院拒绝执行裁决的剩余自由裁量权、误写当事人姓名的后果以及公共政策。一方面,某些法院的判决与《纽约公约》的目标与宗旨保持了一致;另一方面,其他法院作判决时却过于依赖澳大利亚国内法中的原则。
This article analyzes the current state and interpretation of New York Convention’s recognition and enforcement of arbitration rulings in Australia and New Zealand. Although no relevant judgments have been made in New Zealand at present, the Australian courts have examined a series of important issues including the validity of interim awards and interlocutory rulings, the statute of limitations to be applied in the enforcement proceedings, the remaining discretionary power of courts refusing to enforce the rulings, The consequences of the name and public policy. On the one hand, the judgments of certain courts are in keeping with the aims and purposes of the New York Convention; on the other hand, other courts are relying too heavily on the principles of domestic law in their decisions.
