原告德先生和高先生是北京某住宅花园业主委员会的业主代表。自2001年6月起,原告在被告北京某网络公司所经营网站的电子公告板系统(BBS)中,发现有其他用户发表的对原告进行人身攻击和侮辱的数篇文章。在原告提出交涉后,被告陆续删除了上述文章。但是,原告认为被告未能履行其管理和审查的义务,且未能提供文章作者的资料,故向法院提起诉讼,称被告侵害了自己的名誉权,要求被告公开刊登致歉声明、提供文章作者资料,并赔偿损失。
