香港行政特区的“终审权”问题屡屡引发特区司法界的争议并质疑人大释法权有破坏特区司法独立之嫌。本文以国际主权实践的准则说明人大释法是国家对特区主权的体现,特区法院对涉及主权的国家行为并无管辖权。若香港法院想让普通法获取与《基本法》平等的地位,甚至于想凌驾于《基本法》之上,则国家对特区的主权将会受到挑战。为了要争取特区司法独立的无限权力空间,特区司法界和反对派政界人士还效法美国行政司法化的办法,采用司法覆核去削弱行政管治的权力,同时还全面推动公民运动与公民社会教育,藉此强化个人主义的意识形态抗拒民族主义与社会主义,从中灌输直接挑战国家主权的思想。
The “final adjudication” issue of the Hong Kong Special Administrative Region has frequently triggered disputes in the judicial circles of the SAR and questioned the suspicion that the interpretation of NPC by people’s congresses would undermine the judicial independence of the SAR. In this article, the guideline of international sovereignty practice shows that NPC interpretation is the embodiment of the sovereignty of the SAR. The SAR courts have no jurisdiction over state actions involving sovereignty. If Hong Kong courts want common law to acquire equal status with the “Basic Law” and even want to be above the “Basic Law,” the state’s sovereignty over the SAR will be challenged. In order to secure the unlimited power of judicial independence in the SAR, the judicial and opposition politicians in the SAR also follow the example of the administration of justice in the United States, apply judicial review to weaken the power of administration, and at the same time, promote the civic movement and civil society education in an all-round way , Thereby strengthening the individualist ideology against nationalism and socialism and instilling the idea of directly challenging state sovereignty.
