担保物权的竞合是指在同一财产上先后设立或同时设立两个以上的担保物权。对于这个问题很少有学者在一个整体的框架下去分析,就担保竞合的各种类型作出体系化的阐述。本文是在一个框架下去分析论述担保物权竞合的顺位选择的问题,以期进一步明晰担保物权竞合顺位问题的解决思路。
Co-opetition of security interest means that two or more security rights are established successively or simultaneously at the same property. Few scholars on this issue analyze in a holistic framework and systematically elaborate on the various types of collateral competition. This article is in a framework to analyze and discuss the collusive choice of security rights issues, with a view to further clarifying the co-opetition of security rights to solve the problem.
