最高人民法院制定颁布的《关于海事诉讼管辖问题的规定》于2016年3月1日起施行。该司法解释的颁布实施,对完善海事诉讼管辖,推进司法体制改革,更好地服务国家中心工作,为海洋经济发展提供充分的司法保障具有十分重要的意义。本文对此次海事诉讼管辖司法解释起草的背景和原因,相关海事法院管辖区域的调整,海事法院对特定海事行政案件行使管辖权的意义以及海事行政诉讼地域管辖连接点的确定,海事海商纠纷管辖权异议案件的审理等问题进行全面解读。
The Provisions on the Jurisdiction over Maritime Litigation promulgated by the Supreme People’s Court came into force on March 1, 2016. The promulgation and implementation of this judicial interpretation is of great significance to improving the jurisdiction over maritime litigation, promoting the reform of the judicial system, better serving the work of state centers and providing adequate judicial guarantees for the development of the marine economy. This paper analyzes the background and reasons for drafting the judicial interpretation of maritime litigation jurisdiction, the adjustment of the jurisdiction of relevant maritime courts, the significance of maritime courts in exercising jurisdiction over certain maritime administrative cases and the determination of the connecting points of jurisdiction in maritime administrative proceedings, maritime maritime disputes Jurisdiction objection cases and other issues to conduct a comprehensive interpretation.
