本文从近年刑法学出现的新概念“假定承诺”的基本理论入手,着重研究了假定承诺的概念、内涵、意义、发展历程以及假定承诺的正当化。通过将假定承诺与被害人同意、推定承诺相比较,得出了假定承诺的正当化不同于以上两者,而是由于客观归责理论在阻却违法事由中的适用的结论。因此,在医事法学,假定承诺的正当化使得医生的职业风险性降低,使得当前日益严峻的医患关系能通过假定承诺的正当性得以缓解。
This article starts from the basic theory of new concept “hypothetical commitment ” appearing in criminal law in recent years, and emphatically studies the concept, connotation, meaning, development course of hypothetical commitment and the justification of hypothetical commitment. By comparing the hypothetical promise with the consent of the victim and the hypothetical promise, we conclude that the legitimation of the hypothetical promise is different from the above two, but is based on the conclusion that objectivity of imputation theory is applicable in the obstruction of illegality. Therefore, in medical jurisprudence, assuming that the legitimacy of promises reduces the occupational risk of doctors, the current increasingly serious doctor-patient relationship can be alleviated by the legitimacy of hypothetical commitments.
