结合食品安全执法实践,对当前我国《食品安全法》中复检机构选择、过程监控、使用过期食品添加剂、餐饮具集中消毒、从业人员健康管理、肇事单位行政责任等方面存在的问题进行了分析,同时针对这些问题,提出了从立法层面完善惩处机制、把实施标准贯穿于食品加工全过程、将餐饮具集中消毒纳入食品安全法律范畴、落实企业法律责任、转变监管模式、推进诚信体系建设等相应的立法对策。
Combined with the practice of food safety law enforcement, this paper analyzes the existing problems in the current Food Safety Law of China, such as the selection of the institution of reinspection, process monitoring, the use of expired food additives, the centralized disinfection of tableware, health management of practitioners and the administrative responsibility of the accident unit. At the same time, in order to solve these problems, this paper proposes improving the punitive mechanism from the legislative level, putting the implementation standard throughout the whole process of food processing, including the centralized disinfection of tableware into the legal field of food safety, implementing the legal responsibility of enterprises, changing the regulatory mode and promoting the construction of integrity system Corresponding legislative measures.
