《反恐怖主义法(草案)》是我国第一部专门的反恐法草案。草案的规定总体上科学合理,兼顾了反恐怖主义的各种现实需要。从科学立法的角度,即将出台的《反恐怖主义法》应当进一步合理平衡“预防打击恐怖主义”与“保障人权”的关系,注意《草案》与行政法、刑法等相关法律的衔接协调,学习国际反恐立法经验,兼顾国际影响和实际操作,并对一些条文的内容、表述加以完善。 The “Anti-Terrorism Law (Draft)” is China’s first draft of a special anti-terrorism law. The provisions of the draft are generally scientific and reasonable and give consideration to the various real needs of anti-terrorism. From the standpoint of scientific legislation, the forthcoming “Anti-Terrorism Law” should further rationalize the balance between “preventing terrorism against terrorism” and “safeguarding human rights”, and pay attention to the relationship between the “draft” and administrative law, criminal law and other relevant laws Coordinate and learn from the experience of the international anti-terrorism legislation, take into consideration the international influence and actual operation, and improve the content and expressions of some articles.
