21世纪的中国立法趋势将对建设有中国特色社会主义法律体系产生至关重要的决定性影响。立法是经济、政治、文化、道德等综合因素的反映,因此,立法的发展既取决于也受制于这些因素的发展变化。判断或者分析21世纪中国的立法发展趋势,必须设定前提条件,这就是:市场经济体制日渐成熟并运行良好;民主政治体制日益完善并高效廉洁运作;公民文化道德水平不断提高并趋于理性化;国际和平、国内稳定。在这个前提下,根据我国国情并参照法治发达国家的立法发展规律,21世纪中国的立法发展将呈现出立法民主化、立法公开化、立法多元化、立法专业化、立法国际化的趋势。
The trend of China’s legislation in the 21st century will have a crucial and decisive influence on building a socialist legal system with Chinese characteristics. Legislation is a reflection of comprehensive factors such as economy, politics, culture and morality. Therefore, the development of legislation depends on and is subject to the development and changes of these factors. To judge or analyze the development trend of China’s legislation in the 21st century, the preconditions must be set. That is: the market economic system is becoming mature and well-functioning; the democratic political system is getting more and more efficient and clean; the cultural and ethical standards of citizens are constantly improving and rationalized International peace and domestic stability. Under this premise, according to the actual conditions in our country and with reference to the rule of law development in the developed countries under the rule of law, the legislative development in China in the 21st century will show the democratization of legislation, the enactment of legislation, the diversification of legislation, the specialization of legislation and the internationalization of legislation.
