[案情简介]申请人:唐某。被申请人:某制药机械有限公司。申请人诉称:申请人于2012年3月到被申请人处从事汽车司机工作。2012年3月至2014年3月企业一直未与本人签订劳动合同及缴纳社会保险。虽未签订劳动合同,但依据《劳动合同法》规定,属已订立无固定期限劳动合同。经与企业多次交涉,并于2013年12月经劳动争议仲裁部门调解,双方签订了期限为2014年3月至2016年3月的三年期劳动合同。2014年12月27日,因工作原因,申请人的各种证件丢失,申请人找到企业负责人协商是否给予一定协助补办
[Case Profile] Applicant: Tangmou. Respondent: A Pharmaceutical Machinery Co., Ltd. The claimant claimed: In March 2012, the claimant went to work for the driver of the automobile as the respondent. From March 2012 to March 2014, the company has not signed any labor contract and paid social insurance. Although no labor contract has been signed, according to the “Labor Contract Law”, it has been concluded that there is no fixed-term labor contract.
