留置权是债权人在债务人不按照合同约定的期限履行债务时有权依照法律规定留置财产,并以占有的债务人的动产折价或者以拍卖、变卖该财产的价款优先受偿。海上货物运输中船东的留置权与普通法中的留置权既有相似也有不同的地方,本文意在对海上货物运输中法定的和合同确定的运费留置权及其实现方式作简要总结,并对其中的某些方面提出自己的观点。
Lien is the right of the obligee to reserve property in accordance with the law when the debtor does not perform the obligation according to the contract, and the preemptive payment is made based on the discount of the movable debtor or the auction or sale of the property. The shipowners’ lien in the carriage of goods by sea is similar to and different from the lien in the common law. This article is intended to give a brief summary of the lien of the freight and the way to realize it in the carriage of goods by sea. Put forward some opinions on some of them.
