近年来,随着机动车保有量的快速增长和车险市场的不断拓展,车险理赔纠纷大量增长,新诉由纠纷明显增多,而公众对于机动车保险理赔的服务能力和服务质量的要求却越来越高。上海市机动车保险业近年来发展迅速,对改善和促进民生、提升城市发展软实力、促进社会风险管理体系的完善产生了重要影响,但同时车险“理赔难”的问题也突显出来,2008年至2009年浦东法院共受理车险纠纷458件,2010年至2011年上升至989件。2012年7月24日,上海市高级人民法院和浦东新区人民法院联合举办了机动车保险法律问题研讨会,来自最高人民法院和上海市三级法院的法官、专家学者以及保险业界人士等100余人与会研讨。
