法官在刑事裁判领域的角色和作用是必不可少的,不仅对法律的选择和适用需要法官的能动性,在对案件事实进行确认和筛选的过程,也会体现出法官的个人影响。法官对刑事裁判活动的影响主要是基于法官个人对法律的解释、法官的个人经历、法官的裁判心理定势、法官的理论素养等方面存在的差异,这种差异对裁判结果具有重要的影响。
The judge’s role and role in the field of criminal adjudication is indispensable.
