《法国民法典》关于劳动力租赁的规定,体现了民法的局限。劳动力天然属于自然人个人所有,它不是民法所指称的物,不具有可租赁性,不能成为租赁法律关系的客体。劳动力权是第一人权。在存在雇佣关系的社会主义市场经济中,不能仅有保护财产权的法,还应有保护劳动力权的法。劳动力权主要由经济法来确认、设定与保护。我们应完善经济法,保护劳动力权,这是我们践行科学发展观,促进劳资双方和谐发展,建设社会主义现代化强国的必要。
The provisions of the French Civil Code on labor leasing reflect the limitations of civil law. Natural labor belongs to the natural person all, it is not the object of civil law, does not have the rentability, can not be the object of leasing legal relationship. Labor rights are the first human rights. In the socialist market economy where there is an employment relationship, the law should not only protect the property rights, but also the law to protect the labor rights. Labor rights are mainly confirmed by economic law, setting and protection. We should improve the economic law and protect the labor rights. This is the need for us to practice the scientific concept of development, promote the harmonious development of both employers and employees, and build a powerful modern socialist country.
