本文围绕360公司诉“每经”名誉侵权案中的惩罚性损害赔偿判决,分别对侵权报道的损害分析与认定、法人名誉权案中的赔偿法律依据、惩罚性损害赔偿在新闻官司中的运用等进行了较为深入的分析,并针对新闻侵害法人名誉权案中商誉损害数额确定难度大的情形,提出此类案件中可有条件地运用惩罚性损害赔偿机制,并需以确定补偿性损害赔偿金额为前提,明确合适比例。在此基础上,本文认为360公司诉“每经”案中的高额惩罚性损害赔偿判决将给予媒体一个重要的启示:严格遵守法律、恪守职业规范,以便更好地行使其舆论监督职能。
