我国《宪法》以根本法的形式确认了村民自治制度。但是宪法关于村民自治的制度安排还存在一定的缺陷,作为村民自治核心的村民自治权,在宪法中也没有得到应有的体现和保障,这一问题的解决不仅关系到村民自治权利的实现,更关系到我国基层民主政治建设的持续健康发展。
Our Constitution confirms the autonomy system of villagers in the form of fundamental law. However, there are still some defects in the institutional arrangements of the villagers ’autonomy in the Constitution. The autonomy of villagers as the core of villagers’ self-government has not been properly reflected and guaranteed in the constitution. The solution of this issue not only concerns the realization of the rights of autonomy of villagers, But also related to the sustained and healthy development of building grassroots democracy in our country.
