金融消费者保护问题是一个三角关系问题,从法律主体方面来看,涉及到金融服务者、金融消费者、金融监管者三方的关系;从经济学供需关系理论来看,呈现的是金融供给、金融需求以及金融监管三者之间的关系;从保护路径来看,则提供了行业自律、消费者救济、政府监管三大保护路径。本文将试图以三角关系为起点,中间贯穿使用信息不对称理论、委托代理理论、父爱主义理论、公共选择理论等分析工具,希望构建一个从消费者组织、行业协会到监管机构的综合性、全方位的金融消费者保护法律机制。
