为更好地节约能源,提高能源利用效率和经济效益,保护环境,促进国民经济和社会持续发展,根据《中华人民共和国节约能源法》和其他有关法律、行政法规,2000年5月28日,山西省结合实际发布了《山西省节约能源条例》,把节能降耗纳入了法制化轨道,使节能管理工作有了更加明确的执行标准。2011年9月23日,山西省第十一届人民代表大会常务委员会第二十五次会议对该法规进行了修订,新修订的条例规定,固定资产投资项目实行节能评估和审查制度;强化了对重点用能单位的管理,在充实、细化节能激励措施的同时,加大了处罚力度,明确了法律责任;健全了节能评估和审查制度,进一步从源头上遏制不合理的能耗增长。此外,还明确规定商场、宾馆、酒店等大型公共建筑内,空调温度设置不符合规定的要限期改正,否则予以罚款。新修订的条例包括总则、节能管理、合理使用和节约能源、节能技术进步和激励措施、法律责任、附则等6章52条,自2011年12月1日起施行。
