立法法作为规范国家立法制度的法律,具有特殊重要的地位和作用。近日,笔者发现在立法法中有两条特殊规定,值得立法工作者高度关注和准确把握其立法意图。立法法第七十二条第二款规定:省、自治区的人民代表大会常务委员会对报请批准的地方性法规,应当对其合法性进行审查,同宪法、法律、行政法规和本省、自治区的地方性法规不抵触的,应当在四个月内予以批准;第九十七条第四款规定:省、自治区、直辖市的人
