言论自由是一项宪法性权利,是最基本的人权。言论自由彰显的价值对促进社会的发展具有重大而深远的影响。很多民主国家都在宪法条款中对言论自由加以原则性规定并给予国家强制力保护。健全的社会发展包括经济发展、人文关怀、社会正义、环境协调四大要素,呈现三角锥的结构,以经济发展、人文关怀、环境协调为三个基点,而社会正义处于锥体的顶端。本文主要围绕言论自由与社会发展之间存在辨证统一关系、言论自由与社会发展之间的冲突及有效解决途径展开论述。
Freedom of expression is a constitutional right and the most basic human right. The value of freedom of expression has a significant and far-reaching impact on the promotion of social development. Many democracies provide for the principle of freedom of speech and constitutional protection in the constitutional provisions. Sound social development includes the four major elements of economic development, humanistic concern, social justice and environmental coordination. The structure of the triangular pyramid assumes the three basic points of economic development, humanistic concern and environmental coordination. Social justice is at the top of the cone. This article focuses on the existence of dialectical unity between freedom of speech and social development, the conflict between freedom of speech and social development, and effective solutions.
