一、案例简介:1998年9月28日,湖南省永州市中级人民法院一审审结了一起本市内的购房纠纷案。在(1997)永中民初字第14号的同一份判决书中,将22户购房者──分别列为原告,将售房者中国房地产开发集团永州有限公司(下称中房永州公司)列为被告,并依原告的诉讼将永州市工商局也列为被告。该判决中,被告永州市工商局不负连带责任,由被告中房永州公司承担向原告退房款的民事责任。对此,被告中房永州公司不服该审判决,向湖南省高级人民法院提出上诉,要求改判。湖南省高级人民法院审理后,作出了撤销永州市中级人民法院一审判决,发回重审的决定。
I. Introduction to the case: On September 28, 1998, the Intermediate People’s Court of Yongzhou City, Hunan Province, concluded the first instance of a purchase dispute in the city. In the same verdict of (1997) Yongzhong Min Chu Zi No. 14, 22 homebuyers were listed as the plaintiffs, respectively, listing the vendor, China Real Estate Development Group Yongzhou Co., Ltd. (hereinafter referred to as Zhongfang Yongzhou Company) As the defendant, and according to the plaintiff’s lawsuit Yongzhou Trade and Industry Bureau also as a defendant. In the judgment, the defendant, Yongzhou AIC, was not jointly and severally liable, and the defendant, Zhongzhou Yongzhou Company, assumed the civil liability to refund the plaintiff. In this regard, the defendant Yongzhou company room refused to accept the trial verdict, to the Hunan Provincial Higher People’s Court for an appeal, request a retrial. After hearing the case, the Higher People’s Court of Hunan Province made a decision of canceling the judgment of the first instance of the Intermediate People’s Court of Yongzhou and sending it back to the retrial.
