食品安全地方法制保障问题研究——以L省为例

《食品安全法》和《食品安全法实施条例》的颁布实施,不仅完善了我国食品安全的监管体制,改善了食品安全的现状,而且有效地保障了公众的身体健康和生命安全。然而,食品安全问题的特殊性和复杂性决定了食品安全监管和保障体制的建设将是一项长期繁复的系统工程,除了在国家层面制定高位阶的法律予以规制外,地方政府也应结合区域特点和实际情况出台符合本地特色的法规、规章、规范性文件,同时加大食品安全的地方行政执法力度,加强食品安全监督机制建设,构建和完善区域性的食品安全法制保障体系。 The promulgation and implementation of the Food Safety Law and the Implementing Regulations of the Food Safety Law have not only perfected the regulatory system for food safety in our country but also improved the status quo of food safety and effectively protected the general public’s health and safety of life. However, the particularities and complexity of food safety issues determine that the construction of food safety regulation and guarantee system will be a long-term and complicated systematic project. In addition to setting high-level laws at the national level for regulation, local governments should also integrate regional Characteristics and the actual situation of the local laws and regulations, regulatory documents in line with local characteristics, while increasing food safety, local administrative law enforcement efforts to strengthen the supervision of food safety mechanisms to build and improve the regional food safety legal security system.
