民商法关系到人民生活生产的方方面面,是与民生问题最为贴近的法律典范。连带责任在我国民商法中扮演者极其重要的角色,虽然民商法的很多领域都有对连带责任都有相关的规定,但是我国却没有一部法律是专门对连带责任进行规定的,并且我国法律学者对于连带责任方面的理论研究也很稀少。本文首先对民商法中的连带责任进行全面的分析,研究探讨了我国现行民商法连带责任中存所在的一些问题,并提出了解决相关问题的对策,以期能够促进我国民商法律的完善。
Civil and commercial law is related to all aspects of people’s livelihood, and is the legal model most closely related to people’s livelihood. The joint and several liability plays an extremely important role in the Civil and Commercial Law of our country. Although there are related provisions in both civil and commercial law in many areas of joint and several liability, none of our laws specifically stipulate the joint and several liability, and our law Scholars have very few theoretical studies on joint and several liability. This article first analyzes the joint and several liability of civil and commercial law comprehensively, studies and discusses some problems existing in the existing joint and several liability of civil and commercial law in our country, and puts forward the countermeasures to solve the related problems in order to promote the improvement of civil and commercial law in our country.
