在罗马法学家的著作类型中,《问题集》属于案例书,不过收集的是虚拟的案例。帕比尼安的《问题集》在这类著作中享有崇高的地位,而它是采用地方论(Topica)的方法写成的。研究某个法学家的特定著作是当代罗马法研究的一条路径。瑞士学者巴布西奥采用这一路径研究了帕比尼安的《问题集》。她认为帕比尼安在其案例分析中运用了地方论,而地方论是在辩证的论证中寻找前提的艺术,地方(Topos)在这种寻找中提供了帮助,而且要在一串法言中才能发现这样的论证过程。相反,荷兰学者雷森认为地方论是发现论据的艺术,她未考虑地方论的辩证论证语境,所以,她在研究某个地方的被运用状况时考察的对象往往是一个法言。
Among the types of writings of Roman jurists, the “problem set” is a case book, but a virtual case is collected. Papinian’s Problem Set enjoys a high status in such works, and it is written in a Topical way. Studying a particular work of a jurist is a way of studying Roman law today. Swiss scholar Babushio uses this path to study Papinian’s Problem Set. She argues that Papinian uses local theory in his case analysis, whereas localism is the art of looking for preconditions in dialectical arguments, where Topos helps in this search, In order to find such a demonstration process. In contrast, Resen, a Dutch scholar, considered the theory of place as the art of discovering arguments. She did not consider the dialectical context of local theory. Therefore, the object of her study of the state of use of a place is often a maxim.
