以“司法独立”为目标的清末司法改革,建立了从中央到地方的新型司法机构,为清末司法转型奠定了基础。本文试阐述清末司法机构改革的具体内容,论述从中央到地方的机构转型,展示其对清末法制变革的影响,并探讨其对当今法制建设的有益经验。
At the end of the Qing Dynasty, the judicial reform aimed at “judicial independence ” set up a new type of judiciary from the central place to the local area, laying the foundation for the judicial transition in the late Qing Dynasty. This article attempts to elaborate on the specific contents of the reform of the judiciary in the late Qing Dynasty, discuss the institutional transformation from the central place to the local area, and show its influence on the legal system reform in the late Qing Dynasty. It also discusses its useful experience in the current legal system construction.
