与1986年相比,新《义务教育法》不但实现了从“义务本位”到“权利本位”的转变,扩充了公平的价值内涵,而且重构了义务教育法律体系和内部的规范结构,增加了程序性保护条款,这塑造出先进的立法理念和完备的规范体系。尽管现行的《义务教育法》仍有一些需要完善之处,然而它已经表现出深切的人文关怀、高超的立法技术和深查民意的良法本色。
Compared with 1986, the new “Compulsory Education Law” has not only realized the transformation from “obligation-based ” to “rights-based ”, expanded the fair value connotation, and reconstructed the legal system of compulsory education and its internal Standardize the structure and increase the procedural protection clause, which shapes the advanced legislative concept and a complete normative system. Although there are still some areas for improvement in the current Law on Compulsory Education, it has demonstrated its profound humane care, superb legislative techniques and the good nature of the deep investigation and public opinion.
