Chinese exporters often become defendants of the U.S. “337 Investigation.” Pursuant to Section 1337 of Title 19 of the United States Code (“Section 337”), the United States International Trade Commission (ITC) reserves the right to order U.S. Customs to permanently reject any product infringing the United States on the U.S. market. In some cases, the power may even extend to downstream products or non-parties’ products that are not listed as defendants. Once defendants lose, its clients are likely to switch to buying their competitors’ products. In the past “337 investigation ”, Chinese enterprises are often forced to pay plaintiffs high fees in order to settle out of court, or not to give up the entire U.S. city
