工程项目合同确立了发包人与总包方的权利义务关系,是发包方与总包方从事工程建设的重要法律依据。合同管理作为工程项目管理的重要内容,其管理水平直接影响着项目实施的质量。通常情形下,工程项目产生的风险和纠纷往往是责任不清、权利不明所致。在签订工程承包合同时认真分析各种风险因素,尽量避免承担风险的条款,在履行合同过程中采取有效措施,可以防范工程执行中法律风险和纠纷的发生。
