多年来,中国证监会对内幕交易的行政处罚一直是打击内幕交易的主要力量。从1993年至今,中国证监会一共处罚了24起内幕交易。对这些案例的初步分析表明:中国证监会在内幕信息的界定、内幕交易的主体范围、如何认定内部人知悉内幕信息、是否需要认定内部人利用了内幕信息、内幕交易非法所得的计算等方面,积极适用相关法律,补充和完善了法律规定的不足,丰富了我国禁止内幕交易法律制度。当然其中也存在一定的不足需要改进。
For many years, the administrative punishment of insider trading by China Securities Regulatory Commission has been the main force to crack down on insider trading.
