公民的言论自由权利是宪法所赋予的基本权利,公民在生活中言论自由应当受到法律保护。但是公民在行使其言论自由权利的同时不能触犯法律,侵犯其他公民的合法权利与社会公共安全、秩序。本文通过对公民言论自由权利进行解读,结合当前网络信息发展特点,探讨保护公民言论自由与打击网络散布谣言的关系,以便能够明确公民言论自由的合理限制与法律边界。
Citizens ’right to freedom of expression is a basic right conferred by the Constitution, and citizens’ freedom of speech in their lives should be protected by law. However, citizens can not violate the law while violating their rights to freedom of speech and violate the legitimate rights and social public safety and order of other citizens. Based on the interpretation of the rights of citizens’ freedom of speech and the current development of network information, this paper explores the relationship between the protection of citizens’ freedom of speech and the fight against the spread of rumors on the Internet so as to clarify the reasonable restrictions and legal boundaries of citizens’ freedom of speech.
