南非友好争议解决(ADR)历史悠久。传统非洲社会存在的协商一致的矫正机制作为主要的冲突解决方式曾一度被殖民主义所扰乱,南非独立调解服务(IMSSA)的建立让传统的ADR得以复兴,其主要提供调解、仲裁和便利化的劳资纠纷服务,并进一步扩展到社会调解领域。南非1995年《劳动关系法》(LRA)的通过,使得大多数的就业纠纷通过调解的方式来解决。南非宪法法院和近期南非的公司管理条例为商业调解提供了重要支持。尽管南非友好争议解决方式的发展还存在一定的不足,如尚无统一的调解法、调解标准等,但南非已意识到调解的重要性,正采取措施让调解越来越多地适用于公司和商事纠纷的解决。
South Africa’s friendly dispute resolution (ADR) has a long history. As the main method of conflict resolution, the consensus-correcting mechanism existing in traditional African societies was once disrupted by colonialism. The establishment of the South African Independent Mediation Service (IMSSA) revived the traditional ADR, which mainly provides mediation, arbitration and facilitation Labor dispute services, and further extended to the field of social mediation.
