死刑是剥夺犯罪分子生命的刑罚方法,是刑罚体系中最具特色的、是最古老、最为严厉的刑种之一。,随着人文主义的兴起和人权运动的发展,生命权越来越受到人们的尊重,使得死刑的存在越来越受到人们的质疑,废除死刑的呼声也日益高涨。然而,对于正处在高速发展的中国来说,由于社会矛盾复杂,及受传统刑罚观念的影响,死刑的保留仍具有不可或缺的意义。现结合我国死刑立法、司法的现状,阐述自己认为保留死刑的观点。
The death penalty is the method of deprivation of criminals’ life. It is the most characteristic penalty system and one of the oldest and harshest torture penalties. With the rise of humanism and the development of the human rights movement, the right to life is increasingly respected by the people, making the existence of the death penalty more and more questionable and the call to abolish the death penalty is also on the rise. However, for China, which is in a rapid development, the retention of the death penalty still has an indispensable significance due to the complexity of social conflicts and the influence of the traditional penalty concept. In light of the status quo of our country’s death penalty legislation and judicature, we elaborate on our own view of keeping the death penalty.
