对于交通肇事罪自首成立的范围,理论界存在狭义说、折中说和广义说三种基本学说,各地司法实践也存在不同的认定标准,造成同罪不同刑的混乱局面。浙江高级人民法院关于交通肇事罪自首认定的内部文件的出台,使本就存在多种理论纷争的交通肇事罪自首问题再次成为学者们关注的焦点。本文分析了三种基本学说,阐述狭义说和折中说的理论漏洞,认为自首制度作为我国刑法的基本量刑制度,应当适用于交通肇事罪的各个量刑档次。
As to the scope of the crime of establishing traffic accident, the theoretical circles have three basic theories: the compromise theory and the broad one. There are also different standards for judicatory practice in different places, resulting in the chaos of different punishments. The introduction of the internal documents of Zhejiang Higher People ’s Court on the cognizance of traffic accident crime surrendered itself turned the issue of surrender of crimes of traffic accident resulting in a variety of theoretical disputes into the spotlight of scholars. This article analyzes three basic theories, expounds the theoretical loopholes in the narrow sense and compromise, and considers that the system of voluntary surrender, as the basic sentencing system of criminal law in China, should be applied to all sentencing grades of traffic accident crimes.
