依法行政的基本原则反-映的是行政法治的基本精神和基本观念,是作为依法行政的准则、要求和评判政府行政行为是否合法的标准、尺度而存在的。我国依法行政的基本原则一般可归结为行政合法性原则、行政合理性原则、行政公平性原则、行政效率性原则和行政责任性原则等。这些基本原则是在借鉴其他国家行政法治的合理成分和积极因素,总结我国依法行政实践经验的基础上总结出来的。
The basic principle of administration according to law is the basic spirit and basic concept of administrative law and rule. It exists as a standard and criterion for the legal administration, and requires and judges whether the government administrative action is legal or not. The basic principles of our administration according to law can generally be attributed to the principles of administrative legitimacy, administrative rationality, administrative fairness, administrative efficiency and administrative responsibility. These basic principles are summarized on the basis of drawing lessons from the rational elements and positive factors of other countries’ administrative law and ruling and summarizing the actual administrative experience of our country.
