《劳动合同法》第八十二条规定:“用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的,应当向劳动者每月支付二倍的工资。”即双倍工资罚则,但对于该条文中工资的具体构成却没有明确的法律规定,在司法实践中颇具争议。笔者通过对相关理论及法律规定深入分析得出结论:未签订书面劳动合同用人单位支付劳动者双倍工资中的工资应包括基本工资、补助补贴费、奖金等收入,但不包括社会保险福利费用、劳动保护费用以及其他与劳动者劳动付出不对等的额外费用。
