物业管理涉及开发建设单位、物业管理企业、业主及业主委员会、公安机关、公用事业单位、居委会等多个主体,要处理好他们之间的权利义务关系,必须用法律、法规来规范。由于法律、法规不健全,衍生出了一系列法律问题,司法机关因缺乏法律依据难以及时处理,致使物业管理中产生的大量矛盾得不到及时解决。法制建设滞后,相关主体间的法律责任不清,处理纠纷无法可依,成为物业管理发展的瓶颈。加快物业管理立法,尽快建立符合我国国情的物业管理法律法规体系,己成为保障物业管理健康发展的当务之急。
