本文以法的形式为基础,从宪法、法律、行政法规、部门规章、地方性法规和规章五个层次出发,输理了我国农村土地承包经营纠纷解决的法律依据,分析了我国农村土地承包经营纠纷存在的主要法律问题,如综合性的纠纷解决法的缺位、农村土地承包经营纠纷的法律缺乏体系性、农村土地承包经营纠纷的地方立法不足和农村土地承包经营纠纷的普法教育存在问题。笔者认为应以《宪法》相关规定为指导,积极促进农村土地承包经营纠纷的综合性立法,完善农村土地承包经营纠纷法律体系,增加农村土地承包经营纠纷的地方性立法,增强农村土地承包经营纠纷的普法教育,才能够保证农民的土地承包经营权,促进农村经济的健康快速发展,构建一个稳定和谐的农村环境。
Based on the form of law, this article starts from the five levels of constitution, law, administrative regulations, departmental rules and regulations, local laws and regulations, and analyzes the legal basis for the settlement of rural land contractual disputes in our country. Disputes exist in the main legal issues, such as the absence of comprehensive dispute resolution law, the lack of systematic legal system of rural land contractual disputes, rural land contractual disputes over the local legislation and rural land contracting disputes over the legal education of the existence of problems. The author believes that the “Constitution” should be guided by the relevant provisions, and actively promote the comprehensive legislation on rural land contractual disputes, improve the legal system of rural land contractual disputes, increase the local legislation of rural land contractual disputes and enhance rural land contractual management disputes Of the popularization of education, we can guarantee the peasants the right to contractual management of land, promote the healthy and rapid development of rural economy, and build a stable and harmonious rural environment.
