土地承包经营权是权利人依法对国家所有和集体所有的的耕地、林地、草地等享有占用、使用和收益的权利。土地承包经营是我国一种特殊的权利。本文分为四个部分,首先是论述了土地承包经营权的性质,采取的是用益物权说,第二部分介绍了现行法律对土地承包经营权流转的规定,第三部分土地承包经营权抵押的规定及分析,分别从法理依据、物权法立法目标和农民利益三个方面进行了分析,最后一部分得出结论,土地承包经营权可以有条件的设定抵押。本文旨在讨论《物权法》颁布后,对土地承包经营权抵押的界定和讨论,希望对实现农村土地经营多样化提供法律保障。
The right to land contract and management is the right of the obligee to occupy, use and benefit from cultivated land, woodland and grassland owned by the state and collectively owned by the state according to law. Land contracting is a special right in our country. This paper is divided into four parts. Firstly, it discusses the nature of the land contractual management right, which is the usufructuary right theory. The second part introduces the current law’s provisions on the circulation of the land contractual management right. The third part is the mortgage of the land contractual management right. The author analyzes the regulation and analysis from three aspects: the legal basis, the legislative goal of property law and the interests of peasants. The last part concludes that the land contractual management right can set the mortgage conditionally. This article aims to discuss the definition and discussion of the mortgage of land contractual management right after the promulgation of the Property Law, hoping to provide legal protection for the diversification of rural land management.
