作为行刑衔接制度的参与主体和监督主体,为了增强行刑衔接制度的绩效,检察机关应对行政机关的行政行为具有一般监督权。在信息共享机制中,具体行政行为和抽象行政行为的信息都应纳入共享机制范围。检察机关介入行政执法行为,应限定于指导行政机关调查收集证据的界线内,同时强化检察机关对行政执法行为的程序性监督措施。
