我国的土地征收制度建立于新中国成立初期,是以土地国家所有制和集体所有制为基础、根据计划经济体制制定的.虽然几经修改,国家权利至上的传统观念依旧渗透其中,征地补偿理论和制度设计的计划经济体制特征明显,与当今的市场经济很不协调.在土地征收中土地权属和土地用途发生了变更,其过程涉及到多个不同利益主体的经济利益分配.改革我国的土地征收制度,研究政府、集体经济组织、失地农民之间最佳的利益联结点,建立合理的征收补偿和利益分享机制,将对加快推进我国城乡经济社会发展一体化进程、完善土地要素市场、实现社会经济的全面协调可持续发展具有重要意义.
