区域经济一体化是20世纪下半叶尤其是80年代以来世界经济发展的显著特征之一。在欧洲、非洲、美洲等区域一体化组织中,若干组织设立了司法机构,如欧洲共同体法院、欧洲自由贸易区法院、安第斯共同体法院、东南非共同体法院、独联体经济法庭等。其中,建立于1952年的欧共体法院及其发展到如今的包括欧共体法院、欧洲初审法院和专门法庭组成的欧盟法院体系无疑是建立时间最久,同时也是最发达、最有效和最成功的。在欧盟庞大和复杂的组织体系中,欧盟法院体系作为国际法上的一类特殊的区域性司法机构,对欧共体——欧盟的一体化发展发挥了不可替代的推动、保障和调控作用。深入研究欧盟法院的历史沿革、特有的运作机制、作用和面临的挑战以及发展趋势,将为全球化背景下的国际司法体制研究提供重要的启示。
Regional economic integration is one of the salient features of world economic development in the second half of the 20th century, especially since the 1980s. In the regional integration organizations such as Europe, Africa and the Americas, a number of organizations have set up judicial bodies such as the Court of Justice of the European Communities, the European Free Trade Area Court, the Andean Community Court, the Community Court of South-East Asia and the Economic Tribunal of the Commonwealth of Independent States. Among them, the European Court of Justice established in 1952 and its development into the present EU court system comprising the EC Court, the European Court of First Instance and the specialized tribunal is undoubtedly the oldest, the most effective, the most effective successful. In the huge and complex EU organizational system, the EU court system, as a special category of regional judiciary in international law, plays an irreplaceable role of promoting, safeguarding and regulating the EU-EU integration. Studying the historical evolution, unique operation mechanism, function and challenges, as well as the development trend of EU Court of Justice will provide important inspiration for the study of international judicial system in the context of globalization.
