行政法与行政学是广义行政研究的两个分支。早期行政学仍保留着受公法传统影响的痕迹,但行政国家的兴起要求公共行政借鉴管理科学模式。逐渐占据主导地位的管理科学模式与传统的公法模式之间产生剧烈的紧张关系,表现为公共行政的“去法化”与行政法的“去行政学化”。围绕公共行政学是行政科学还是政治哲学的争论,忽视了法律路径相对独立于管理路径和政治路径的特殊性质。宪法和行政法的实质性变革、司法审查变迁与“新伙伴关系”的形成、新行政法与治理的兴起,促使公共行政与法律从分离走向动态整合,也使公共行政学实现了从政治与行政二分法到管理、政治与法律三维分析路径的转变。治理代表着公共行政与法律动态整合的实现路径和可能前景,但整合的具体条件和实际效果仍具有开放性和不确定性。
Administrative law and administration are two branches of general administrative research. Early administration still retains traces of the impact of traditional public law, but the rise of administrative countries requires public administration to learn from the management of science. There is intense tension between the increasingly dominated scientific management model and the traditional public law model, which is manifested in the “legalization” of public administration and “de-administrative science” of administrative law. Around the public administration is the administrative science or political philosophy debate, ignoring the legal path is relatively independent of the management and political paths of the special nature. The substantive transformation of constitutional and administrative law, the vicissitude of judicial review and the formation of “new partnership”, the rise of new administrative law and governance, the promotion of public administration and law from separation to dynamic integration, and the realization of public administration from Political and Administrative Dichotomy to Management, Political and Legal Changes in the Way of Three-Dimensional Analysis. Governance represents the realization path and possible prospects of the dynamic integration of public administration and law. However, the specific conditions and actual effects of the integration are still open and uncertain.
