在老百姓心里一直普遍认为,谁拥有房产证谁就是房屋的主人,但其实不动产权属证书相对于登记簿效力更薄弱些,只具有初步证明效力。根据《房屋登记办法》(2008年1月22日建设部第147次常务会议通过,2008年7月1日起施行),房屋登记,是指房屋登记机构依法将房屋权利和其他应当记载的事项在房屋登记簿上予以记载的行为。房屋权属证书、登记证明与房屋登记簿记载不一致的,除有证据证明房屋登记簿确有错误外,以房屋登记簿为准。
In the minds of ordinary people, it has been generally agreed that whoever owns a real estate license is the owner of the house, but in fact the real estate ownership certificate is less effective than the register and has only preliminary proof of validity. According to the Measures for Registration of Houses (Adopted at the 147th Executive Meeting of the Ministry of Construction on January 22, 2008 and implemented on July 1, 2008), registration of houses refers to the registration of housing rights and other items that should be recorded according to law Record in house register. If there is any evidence that the register of houses is in error, the register of houses shall prevail.
