一、规制行政性垄断的制度创新我国《反垄断法》中关于行政性垄断规制的内容,是关于反垄断法意义的讨论中最为引人注目的。法律中禁止行政机关制定限制竞争的行政规定,首次突破了对政策制定行为进行规制的旧传统,这表明《反垄断法》并不是简单的一部法律,而已经是在更为广阔的国家竞争政策的层面加以规范的。但是《反垄断法》实施至今,关于滥用行政权力排除限制竞争的行政性垄断案件查处还是十分困难~(〔1〕)。 I. Institutional Innovation of Regulating Administrative Monopoly The content of the regulation of administrative monopoly in China’s Anti-Monopoly Law is the most striking one in the discussion on the significance of antitrust law. Forbidding the executive authorities from setting an administrative restriction on competition in the law for the first time broke through the old tradition of regulating the formulation of policies. This shows that the Anti-monopoly Law is not a simple law but has already competed in a broader country Policy level to regulate. However, since the implementation of the Anti-Monopoly Law, it has been very difficult to investigate and deal with cases of administrative monopoly that abuses administrative power to restrict competition (1).
